2. The instant application for regular bail has been filed by the petitioner in connection with Parbatta (Maraiya) P.S. Case no. 119 of 2026 instituted for the offence under Sections 103(1), 61 (2) and 3 (5) of the B.N.S and Section 27 of the Arms Act.

3. The prosecution case, in short, is that Raja and Sudama Kumar have fired at the brother of the informant who succumbed to the injuries.

4. Learned counsel for the petitioner has submitted that in latter part of the F.I.R., it is alleged that the petitioner along with others have hatched a conspiracy wherein the brother of the informant was killed. Learned counsel for the petitioner

Patna High Court CR. MISC. No.35375 of 2026(2) dt.21-05-2026 2/2 has submitted that from the perusal of the F.I.R, itself, it is clear that specific allegation of firing is against Raja Kumar and Sudama.

5. Countering this, the learned counsel for the informant has vehemently opposed the bail application of the petitioner as there is direct allegation against the co-accused Raja and Sudama. There is no allegation of any overt act against this petitioner. Petitioner is having no criminal antecedent, he is in custody since 19.03.2026.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail in connection with Parbatta (Maraiya) P.S. Case no. 119 of 2026, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria.
