Petitioner is accused in connection with Ekchari P.S. Case No. 06 of 2015 registered under Sections 302/34 of the I.P.C.
The allegation of informant Manju Devi is that she along with her husband and son Antesh Kumar reached at the Tempo Stand to go to attend the marriage ceremony, but due to non-availability of vehicle, her husband suggested her to return home and he will alone attend in the marriage ceremony. In that course, petitioner came and made some talk with her husband. Thereafter, the informant returned back her house and on the next day in the morning, she came to know from the villagers that the
Patna High Court Cr.Misc. No.18863 of 2016 (3) dt.22-06-2016 2/2 dead body of her husband is lying in the field of Moti Lal. The informant raised suspicion against the petitioner about having hand in the murder of her husband.
Learned counsel appearing on behalf of the petitioner submits that petitioner is co-villager of the informant and has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent and is in custody since 14.05.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhagalpur in connection with Ekchari P.S. Case No.06 of 2015 (G.R. No. 1589 of 2015). Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J) Shail/- U T
