JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-01-2015 The petitioner is informant of Beur P.S.Case No.295 of 2013 dated 16.12.2013 registered for the offences punishable under sections 447, 341, 323, 324, 307 and 504 read with 34 of the Indian Penal Code.

In the said case five persons were made named accused. By filing the present writ petition under Articles 226 and 227 of the Constitution of India, the petitioner seeks a direction to be issued upon the respondents particularly respondent nos.3 to 5 to take appropriate action in respect of the aforesaid police case. In my view, the writ petition is misconceived. The police case is still under investigation and there is nothing on the basis of which it can be presumed that proper legal action is not being

Patna High Court Cr. WJC No.46 of 2014 (2) dt.09-01-2015 2/2 taken in the matter by the investigating agency. At the stage of investigation, the court has no role to play.
