The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 427/504 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case is that on 20.03.2019 while the informant Raj Kumar Sharma and his brothers Dharmendra Sharma and Dhananjay Sharma were at their ply shop, the accused persons named in the F.I.R. including petitioner reached there, began to abuse and damage the articles. They also began to assault with lathi and danda. Vicky Pandey opened fire in air. They assaulted Dharmendra Sharma and Ganesh Nag with intent to kill.
Patna High Court CR. MISC. No.33042 of 2019(3) dt.22-08-2019 2/2 Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. He further submits that similarly situated co-accused have been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 30111 of 2019 on 10.05.2019.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Obra Police Station Case No. 64 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
