The petitioner is accused in connection with Pandarak P.S. Case No. 14 of 2015, registered under Section 25(1-b)a/26/35 of the Arms Act.

The accusation is of recovery of one loaded country made pistol along with four live cartridges were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the house of the petitioner was raided by the Police in respect of Pandarak P.S. Case No. 13 of 2015, under Section 302/34 of the I.P.C. and Section 27 of Arms Act and petitioner was apprehended in the said case, who is still in custody. The petitioner has falsely been implicated in this

Patna High Court Cr.Misc. No.19469 of 2016 (2) dt.05-05-2016 2/2 case. The petitioner is in custody since 11.03.2015 in the present case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Barh-Patna in connection with Pandarak P.S. Case no. 14 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
