JUSTICE PURNENDU SINGH ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner seeks regular bail in connection with Bela P.S. Case No. 255 of 2019, registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act, pending in the Court of learned Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi.

The prosecution story, in brief, is that petitioner along with other named in the F.I.R. were caught, while they had assembled to make preparation for committing dacoity. According to the prosecution case itself, firearm was recovered from the possession of other accused.

No.44139 of 2021(4) dt.01-04-2022 2/2 Taking into consideration the nature of allegation made against the petitioner as well as antecedent of the petitioner, who is involved in nine other criminal case, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the prayer for grant of regular bail is rejected. However, he may renew his prayer for bail after undergoing six months further period of custody. With the above observation, the present bail application is disposed of.
