JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State.

The petitioner is in custody in a case registered under Sections 392, 412, 34 of the Indian Penal Code. The prosecution case, in brief is that on 18.07.2014 the informant submitted a written report before the Officer-in-charge, Mokama P.S. alleging that he being the driver of the pick-up van while going to Munger Mandi from Patna, four persons on a Sumo vehicle suddenly overtook his pick up van and hijacked his vehicle after he was tied on a poll. However, he managed to reach the Mokama police station and on the basis of the information provided by him the police has instituted the present case.

It is submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.24988 of 2015 (2) dt.21-07-2015 petitioner is in custody since 20.04.2015 and the charge sheet has been submitted in this case. It is further submitted that the petitioner is not named in the F.I.R. and the other co-accused has been granted bail by this Court vide Cr. Misc. No. 8285 of 2015 and Cr. Msic. No. 12942 of 2015. On behalf of the State it submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sri Ashutosh Kumar, learned J.M.Ist Class, Barh, District Patna in connection with Mokama P.S.
