Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the First Information Report but in course of investigation, it came to light that SMS of demand of extortion money had been sent through the SIM of the petitioner.
Submission on behalf of the petitioner is that, as a matter of fact, petitioner had given his documents to dealer of SIM but on this and that pretext, the concerned shopkeeper did not hand over the SIM to the petitioner and used the documents of the petitioner. It is further submitted that petitioner does not have any
Patna High Court Cr.Misc. No.18162 of 2016 (2) dt.02-05-2016 2/2 criminal antecedent and is languishing in jail custody since 19.02.2016. Moreover, it is also informed that petitioner is a student and he has already been selected in Assam Rifles Examination, 2015 and his medical test is going to be held on 11.5.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Munger Kotwali P.S.Case No. 47 of 2016.
