JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-07-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 504 and 506/34 of the Indian Penal Code. It is a case of assaulting due to which informant Bhushan Ram and his wife and other family members sustained injury.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injury as alleged in separate incident. On perusal of the injury report mentioned at para nos.34, 35 and 36 of the case diary, it appears that there

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, East Champaran at Motihari in connection with Paharpur P.S. Case No. 114 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
