2. The petitioner has prayed for bail in a case registered for the offence punishable under section 412 of the Indian Penal Code.
3. It is a case of snatching of motorcycle by three unknown miscreants. It is further alleged that on protest made by the informant, accused person assaulted him by means of rod resulting into head fracture. Allegedly, petitioner in connivance with two other accused persons sold out the said stolen motorcycle to Jugeshwar Chaudhary.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Nothing has been recovered from conscious possession of the petitioner.
Patna High Court CR. MISC. No.44754 of 2023(2) dt.28-07-2023 2/2 His name transpired in this case on the basis of confessional statement of co-accused Mantu Kumar, who was granted bail by the learned lower court. Petitioner is languishing in judicial custody since 14.10.2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Koilwar PS Case NO. 576 of 2022.
