The petitioner apprehends his arrest in a case registered for the offence under Section 188, 307 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted on behalf of petitioner that though, petitioner is alleged to have made fire through his licensee gun, but no one sustained any injury. F.I.R. has been lodged after 12 days of the alleged occurrence, which creates doubt on the prosecution case. Petitioner is an army personnel and he fired from his licensee gun in a marriage party, as celebratory firing. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in
Patna High Court CR. MISC. No.35085 of 2022(2) dt.01-11-2022 2/2 the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Lakhisarai in connection with Piri Bazar P.S. Case No. 65 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
