JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This application, for grant of anticipatory bail, arises out of Madhaura P.S. Case No. 189 of 2019, disclosing offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016 Prosecution case is that on information that petitioner is manufacturing illicit mahua liquor near the poultry farm in Bhwalpur Chowr, the informant along with other police officials raided the place and recovered 20 litres of mahua liquor. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and in fact nothing has been recovered in this case and further petitioner is ready to abide by any condition imposed on him for grant of anticipatory bail.

Having heard both sides, in view of above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. - IX, Saran at Chapra, in connection with Madhaura P.S. Case No. 189 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
It is further subject to the condition that petitioner shall cooperate in the investigation and make himself available as and when required by the police, otherwise, his bail bonds shall be cancelled.
