This application for grant of regular bail arises out of Dhangai P.S. Case No.31 of 2023 registered for the offence punishable under Sections 320, 170, 376, 354(C), 465, 468, 469, 425, 120-B and 348 of the Indian Penal Code and under Sections 66 and 67 of the I.T. Act.

As per the prosecution case, the allegation against the petitioner is of committing rape of victim and making the video viral.

During investigation, the allegation of committing rape has been found false and charge-sheet has been submitted against the petitioner under Section 384, 354(B), 504, 506 and 509 of the Indian Penal Code. The petitioner is in custody since 22.02.2022. He has clean antecedent.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Dhangai P.S. Case No.31 of 2023.
