The petitioner seeks his bail in a case registered under Section 302 IPC.

The petitioner is not named in the FIR. The name of the petitioner and other accused persons transpired during the course of investigation. The allegation against the petitioner is that he killed the deceased by giving him poison in the liquor. It is submitted that similarly situated co-accused has already been enlarged on regular bail vide order passed in Cr.Misc.No.9195 of 2015.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S.Case No.754 of 2014.
