The petitioner apprehends his arrest in Chhauradano P.S. case No. 36 of 2018 registered under Section 341, 420, 384, 504, 506/34 of the IPC.

The informant alleged that he purchased land from Ram Narayan Choudhary, Bhagya Narayan Choudhary, Surendra Choudhary, Birendra Choudhary and Girendra Choudhry in the name of his wife Chandrawati Devi. The name of Chandrawati Devi was also mutated but Om Prakash Rai, Rajesh Rai and others got fraudulent sale deed executed in their favour from Most. Panna Kuwar.

The learned counsel for the petitioner submits that father-in-law of Panna Kuwar got the land from her ancestors.

Patna High Court CR. MISC. No.32275 of 2019(2) dt.15-05-2019 2/2 Panna Kuwar, Om Prakash Rai and two others have already been granted anticipatory bail vide order dated 05.07.2018 passed in Cr. Misc. No. 38010 of 2018 and the case of petitioner stands on the same footing.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that accusation is of civil in nature and similarly situated accused have already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Raxaul, Motihari in connection with Chhauradano P.S. case No. 36 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
