2. The petitioner seeks bail in connection with Mohania P.S.Case No. 167 of 2024 registered for the offence punishable under Sections 8 (c), 22 of the Indian Penal Code and Sections 25 (1-b) a and 26/35 of the Arms Act.

3. The recovery is of intermediate quantity of the banned substance i.e. 1.7518 gm from the petitioner.

4. Learned counsel for the petitioner submits that petitioner is in custody since 15.03.2024 and he has claimed clean antecedent.

5. Considering the recovery of intermediate quantity of banned substance, this application is allowed.

6. Let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Kaimur at Bhabhua in Mohania P.S.Case No. 167 of 2024.

7. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Mohania Police Station on 1st and 3rd Sunday of every month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner.

8. The petitioner has claimed clean antecedent. At the time of accepting the bail bonds of the petitioner, the court below shall verify the criminal antecedent of the petitioner and if it is found that the petitioner has clean antecedent, the court below shall accept his bail bonds. If it is found that the petitioner is involved in any other case, his bail bonds shall not be accepted by the court below.
