Petitioner seeks regular bail in connection with Mufassil (Aurangabad) P.S. Case No. 120 of 2020 (General Registration No. 643 of 2020) registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The allegation as per the First Information Report is that Police raided the house of the petitioner and recovered a total quantity of 143.880 liters of illicit foreign liquor from the room of the petitioner.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive. Learned counsel further submits that petitioner has got no criminal antecedent and he is in custody since 04.09.2020.

No.35384 of 2020(2) dt.05-01-2021 2/2 Learned counsel also submits that charge sheet has already been submitted in this case and there is no apprehension that the petitioner will abscond or tamper with the evidence. Having regard to the submissions made by the parties and taking into consideration the materials available on record , the fact that petitioner has got no criminal antecedent, he is in custody since 04.09.2020 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VII-CumSpecial Judge (Excise), Aurangabad / court concerned in connection with Mufassil (Aurangabad) P.S. Case No. 120 of 2020 (General Registration No. 643 of 2020).

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
