JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek regular bail in a case registered for the offences punishable under sections 379 of the Indian Penal Code.

The informant has alleged in the F.I.R. that he withdrew Rs.90,000/- from the State Bank of India, Jamui and kept the same in his bag. In the meantime, a Motor cycle came and its rider snatched the bag and fled away. On behalf of the petitioners it is submitted that the petitioners are in custody since 27.03.2015. Charge-sheet has

Patna High Court Cr.Misc. No.26540 of 2015 (2) dt.27-07-2015 been submitted in the case. The petitioners are not named in the F.I.R. nor there is recovery of any incriminating article or theft property from their possession.

On behalf of the State, it is submitted that the name of the petitioners has come in course of investigation. Considering the facts aforesaid, let the petitioners above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case no. 67 of 2015.
