1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Katihar Town P.S. Case no. 311 of 2022, registered under sections 447, 341, 323, 308, 354A, 504 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the eight named accused persons including the petitioners herein started to assault the informant but she was saved on the

Patna High Court CR. MISC. No.36689 of 2025(2) dt.05-06-2025 2/3 intervention of the villagers. It is further stated that on the date of occurrence, the petitioner no.1 assaulted her with an iron rod as a result of which she sustained injury on her head.

4. Learned counsel for the petitioners submits that from the contents of the FIR itself it would transpire that the parties are members of a family and there is pending land dispute between them. The allegations besides being general and omnibus in nature, the injury attributable to the petitioner no.1 has been found to be simple in nature. The petitioners have no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners in the F.I.R., the contents of the injury report, the relationship between the parties and the petitioners not having any criminal antecedent, it is directed that all the five petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Katihar Town P.S. Case no. 311 of 2022 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like

Patna High Court CR. MISC. No.36689 of 2025(2) dt.05-06-2025 3/3 amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
