JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Dumraon P.S. Case No. 75 of 2016, registered under Section 419,420,467,468 and 471 of the Indian Penal Code and under Section 10 of Bihar School Examination Control Act, 1981. The accusation is that the informant being the Static Magistrate of Matriculation Examination got information about presence of eight persons in Bolero in the play ground of Raj High School, Dumraon, then he along with other armed forces reached there, where he found 08 persons, including the petitioners, sitting in the Bolero vehicle. It was detected from their mobile that they have loaded question and answer of the

Patna High Court Cr.Misc. No.19288 of 2016 (2) dt.05-05-2016 2/2 matriculation examination.

Learned counsel for the petitioners submits that the allegation as made in the F.I.R. is taken to be true in such circumstances also there was no occasion for conveying the answers by the petitioners and other to the candidate of matriculation examination in the examination hall as candidates were not allowed to appear in the examination with any electronic device. Further submission is that, in fact, the petitioners have been implicated in this case mere on suspicion and having no criminal antecedent in custody since 15.03.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 75 of 2016.
