Patna High Court CWJC No.8683 of 2020(6) dt.30-10-2024 2/3 ORAL ORDER 30-10-2024 The present writ petition has been filed seeking the following reliefs:- "(I) For directing the Respondents to remove encroachment and comply with the order passed by the Superior Court, within a stipulated period fixed by this Hon'ble Court.
(II) For directing the Respondent No.5 to initiate encroachment proceedings immediately and remove the encroachment from the public road within a stipulated period, to be fixed by this Hon'ble Court.
(III) For restraining the private Respondents from making further construction over the aforesaid public land, appertaining to Khata No.90, Plot No. 1057, Area 2 decimal, situated at Thana No. 460, Mauza- Saidpur Dumra.
IV) For direction to initiate disciplinary proceedings against the Respondents No. 5 and 6."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
