ANJANA MISHRA ORAL ORDER 01-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner being a P.D.S. dealer apprehends his arrest in Tekari P.S. Case No.71 of 2016 for the offence under Section 7 of the Essential Commodities Act.
Learned counsel for the petitioner submits that due to animosity between the petitioner who is a P.D.S. and the Block Supply Officer, the present case has been lodged only to harass and humiliate the petitioner on account of personal grudge and dirty village politics.
Considering the facts and circumstances and nature of allegation, let the petitioner, above named, in the event of his arrest or surrender before the court below with for weeks from
Patna High Court Cr.Misc. No.18382 of 2016 (3) dt.01-06-2016 2/2 today, let the petitioner, above named , in the event of his arrest of surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Gaya, in Tekari P.S.Case No.71/16 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
