Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Petitioner is in custody since 28.07.2017. Allegation is that the petitioner had taken the deceased from his house and, thereafter, dead body was found.
Submission is that false implication is there due to land dispute. Earlier prayer for bail was refused on 05.04.2018 with liberty to renew the prayer for bail if the trial is not concluded within one year. Trial has not concluded as yet. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.32523 of 2019(2) dt.17-05-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. No. 144 of 2017/CIS No. 144 of 2017 arising out of Gwalpara (Arar O.P.) Police Station Case No. 87 of 2016, with the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
