2. Heard learned counsel for the petitioner and learned A.P.P. for the State.
3. The petitioner seeks regular bail in connection with S.T. No. 350 of 2023, arising out of Muffasil P.S. Case No. 596 of 2022 dated 15.11.2022 lodged under Sections 302/34 of the I.P.C.
4. As per the F.I.R., the allegation of torture and killing of the daughter of the informant against four named accused persons.
5. Learned counsel for the petitioner submits that petitioner is father-in-law aged about 55 years. He further
Patna High Court CR. MISC. No.39112 of 2023(2) dt.07-07-2023 2/2 submits that from the F.I.R. there is an allegation of torture and killing. He further submits that marriage was solemnized 12 years back and there is nothing specific against the petitioner.
6. Learned counsel for the State opposes the prayer for bail and submits that husband of the deceased has not surrendered till date.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, after furnishing of certificate that the husband of the deceased has surrendered, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Begusarai in connection with S.T. No. 350 of 2023, arising out of Muffasil P.S. Case No. 596 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
8. With this observation, the bail application stands allowed.
