JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 16.6.2014 in connection with Kotwali P.S. Case No.97 of 2014 corresponding to S.Tr.No.752/14 for the offences instituted under Sections 364(A)/120(b) of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the petitioner happens to be the driver of the Santro Car of the informant by which he had taken the son of the informant to the New Patna Club but he did not return till 7.34 P.M. and a call for ransom of Rs.2/- crores for release of the son of the informant was made on the mobile of the informant.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.24722 of 2015 (3) dt.12-08-2015 2/2 petitioner is in custody since 16.6.2014 and the charge sheet has been submitted in the present case. The petitioner has no criminal antecedent. From perusal of the statement of 164 Cr.P.C. it appears that the victim has not named the petitioner. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C. 4, Patna, in connection with S.Tr.No.752/14 arising out of Kotwali P.S. Case No.97 of 2014.
