JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned APP. The petitioner seeks bail in a case registered for the offences punishable under Sections 366 and 366A of the Indian Penal Code.

The petitioner Golu Kumar, Munni Devi and Subodh Kumar were the tenant of the informant. The informant alleged that earlier he filed informatory petition against the petitioner. The petitioner kidnapped his minor daughter and demanded ransom of Rs. 2 lakhs. The victim appeared and made her statement under Section 164 of the Cr.P.C. in which she disclosed that she called the petitioner and went along with him but she was brought and brutally assaulted by her mother. Learned counsel for the informant submits that the victim is admittedly a minor and the petitioner had enticed her. It appears from the statement of the victim itself that the victim herself went along with the petitioner and she did not complain any ill-treatment at the hands of the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Town P.S.
