This application for regular bail in RC 07/(A)/2018, arises out of Spl. Case No. 04/2020, Kotwali (Bhagalpur) P.S. Case No. 545 of 2017, disclosing offence punishable under Sections 409, 419, 420, 467, 468, 471, 120-B, 34 of the Indian Penal Code.
Petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 04.01.2021, passed in Cr. Misc. No. 25810 of 2020. The said order takes into account in detail the case of the prosecution which arises out of
Patna High Court CR. MISC. No.44285 of 2021(8) dt.19-01-2022 2/3 infamous Srijan Scam. The petitioner has admittedly been implicated in eight cases in relation to his conduct as a Clerk in Bhagalpur Branch of Indian Bank.
Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been granted bail in six out of eight cases which also make out similar allegation against the petitioner. He has further submitted that the petitioner was taken into custody on 12.08.2017 in one of the cases and subsequently he came to be remanded in the present case on 17.02.2020, since when he is in custody in connection with this case. He has further submitted that some of the co-accused persons having similar allegations have been allowed bail by this Court. He contends that Pradyut Kumar Biswas @ P.K. Biswas @ Vishwas, Assistant Branch Manager of the Bank has been allowed bail by an order of this Court dated 13.08.2021, passed in Cr. Misc. No.
8635 of 2021, Barun Kumar, Joint Manager, Bank of Baroda, Bhagalpur Branch has been allowed bail by this Court by an order dated 04.10.2021, passed in Cr. Misc. No. 35068 of 2021. One Deo Shankar Mishra, Branch Manager of Indian Bank, Bhagalpur Branch has been allowed regular bail by this court by an order dated 01.12.2021, passed in Cr. Misc. No. 33112 of 2021.
Patna High Court CR. MISC. No.44285 of 2021(8) dt.19-01-2022 3/3 allowed regular bail by the Hon'ble Supreme Court by an order dated 17.07.2020, passed in Criminal Appeal No. 484 of 2020. Considering the petitioner's period of incarceration and the fact that similarly circumstanced co-accused have been allowed regular bail, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Special Judge, C.B.I.-II, Patna, in RC 07/(A)/2018, arising out of Spl.
