The petitioner seeks bail in connection with Jakkanpur P.S. Case No. 471 of 2022 dated 04.09.2022 registered for the offence punishable under Section 366(A) of the Indian Penal Code and 8/12 of the POCSO Act. The allegation against the petitioner is that the minor daughter of the informant fled away with him on the pretext of marriage.
Learned counsel for the petitioner submits that the petitioner had not taken the daughter of the informant with him and the victim in her statement under Section 164 Cr.P.C. stated that she herself went to the house of her Bua (Aunt) at Ara because she had quarrel with the brother and parent of the
Patna High Court CR. MISC. No.35590 of 2023(2) dt.07-07-2023 2/2 victim. She has not alleged any allegation against the petitioner. The petitioner has no criminal antecedent and is in jail custody since 08.09.2022.
Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, VIth -cum-Sepcial Judge, POCSO, Patna in connection with Jakkanpur P.S.
