The petitioner seeks bail in connection with Rosera P.S. Case No.60 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 272 and 273/34 of the Indian Penal Code.
Considering the submissions made by the learned counsel for the petitioner that the alleged 35.640 liters of illicit liquor was recovered from the orchard and not from conscious possession of the petitioner, the petitioner, who is in custody since 26.03.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cum-Special Judge, Excise Act,
Patna High Court CR. MISC. No.32949 of 2019(2) dt.20-05-2019 2/2 Samastipur in connection with Rosera P.S. Case No.60 of 2019 subject to the following conditions:- (a) that the petitioner shall attend court in accordance with the conditions of the bond executed, (b) that the petitioner shall not commit an offence similar to the offence of the present case, and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
