02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Brahmpur P.S. Case No. 378 of 2019, registered for the offence under Sections 420, 414, 120(B) and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

631 liters & 620 ml. of illicit foreign liquor has been recovered from Nainizor old hospital and name of petitioner has surfaced during course of investigation, as the person, who brings liquor from U.P. to Bihar.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The recovery has been made from a hospital and petitioner has got no concern with the same. Petitioner has got clean antecedent and he is in custody since 05.03.2021.

Patna High Court CR. MISC. No.44047 of 2021(3) dt.02-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II cum Special Judge Excise, Buxar in connection with Brahmpur P.S.
