JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is in custody since 09.03.2016 in connection with Mohania P.S.Case No.313 of 2015 registered for the offence under Sections 302/34 of the IPC and Section 27 of the Arms Act. As per the prosecution case, it is alleged by the informant that while a Jeweler returning back from Varanasi to Mohania by a bus at around 6.00 PM as soon as he reached near Toll Tax, Bus was stopped by two unknown miscreants who had concealed their faces, started dragging the deceased for alighting him down from the bus who replied that he had not taken anything thereafter one of the miscreants shot at his chest, cartridge piercing his body hit in the left thigh of the informant's mother.

Patna High Court Cr.Misc. No.17256 of 2016 (3) dt.24-05-2016 It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.03.2016. Petitioner has got no criminal antecedent. Chargesheet has been submitted in the case. Petitioner is a jeweler. As per the confession of a co-accused, it is alleged that the looted jewelry is said to have been sold to the petitioner. Petitioner had no knowledge that the jewelry was looted one. There is no other material to show that the petitioner was anyway involvement in the commission of the murder of the deceased.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Bhabua (Kaimur) in connection with Mohania P.S.Case No.313 of 2015.
