The petitioner seeks bail in S.Tr. No. 200/2019, arising out of Hasanpur P.S. Case No. 270/2018, instituted for offences under Section(s) 307, 323, 324, 325, 341 and 34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence son of informant had gone to attend call of nature and returned back in injured condition. Thereafter he was brought to hospital. The informant raised suspicion against this petitioner and one Wakil Tanti for causing injury to her son because there was dispute between her son and the petitioner and co-accused Wakil Tanti.
Patna High Court CR. MISC. No.32135 of 2019(3) dt.16-07-2019 2/2 Learned counsel for the petitioner has submitted that informant is not eye-witness to the occurrence. Mere suspicion has been raised against this petitioner.
Petitioner is in custody since 01.01.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IInd, Rosera, Samastipur, in connection with S.Tr. No. 200/2019, arising out of Hasanpur P.S. Case No. 270/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
