1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 384, 387 and 307 of the Indian Penal Code and 25(1-b)a 26, 35, 27 of the Arms Act.

3. This petitioner has been made accused in this case on the basis of confessional statement of co-accused who was apprehended with arms and ammunition.

4. It is submitted on behalf of the petitioner that no incriminating material has been recovered from the possession of the petitioner and he has been made accused in this case only

Patna High Court CR. MISC. No.35545 of 2023(2) dt.21-07-2023 2/2 on the basis of confessional statement of the apprehended person.

5. Learned counsel for the State opposes the bail petition of the petitioner and submits that this petitioner has been named in the FIR and has got two criminal antecedent.
