1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 317(2), 303(2), 325(3) and 3(5) of the B.N.S., 2023.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 30.08.2025 at 12.30 P.M. he was informed that accused persons are loading his pigs on a pick up vehicle, accordingly, he reached the place of occurrence with his five sons, when accused persons fled but two accused were

No.37535 of 2026(2) dt.22-06-2026 2/3 apprehended who disclosed their name and Mukesh and Tinku and on search, 10 pigs were found loaded on the pick up vehicle, further apprehended accused disclosed the name of accused who fled including the petitioner, accordingly the apprehended accused were handed over to the police.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner was not apprehended from the spot and his name transpired in the extra judicial confession of the accused who were apprehended by the informant and his son which does not have any evidentiary value. It is reiterated and submitted that petitioner is a person with clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection
