The petitioner is in custody since 1.12.2014 in connection with Chandramandi P.S. Case No.78 of 2013 registered for the offence under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and has been implicated in this case on the basis of the confessional statement of one Amerika Yadav @ Amerik Yadav, who has been granted regular bail by this Court in Cr.Misc. No.50625 of 2013, vide order dated 6.1.2014. Learned counsel for the petitioner submits that till date there has been no T.I. Parade and the petitioner is languishing in
Patna High Court Cr.Misc. No.10944 of 2015 (3) dt.25-05-2015 2/2 jail. The petitioner has stated in paragraph 3 of the petition that apart from the present case, he is an accused in another case, bearing Chandramadih P.S. Case No.27 of 2004. Considering the period of custody and also the fact that the petitioner's name has surfaced on the confessional statement of one Amerika Yadav and the said Amerika Yadav has already been granted regular bail by this Court, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui, in connection with Chandramandi P.S. Case No.78 of 2013. (Anjana Mishra, J) PNM U T
