JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 13.01.2015 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
On commission of dacoity in the house of the informant the First Information Report was registered against 15-16 unknown. The name of the petitioner sprang up on confessional statement of co-accused Sanjay Ram @ Santosh Ram arrested in another case being N.T.P.C Khaira P.S. Case No. 97 of 2013.
A statement has been made in para 11 of the petition that neither any recovery has been made from the petitioner nor the petitioner has been put on test identification parade.
Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.25753 of 2015 (2) dt.24-07-2015 2/2 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 4 of 2014.
Since the petitioner has serious criminal antecedent, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities, i.e. if the petitioner substantially gets involved in some serious nature of offence or defaults for three consecutive ocassions.
