JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

The prosecution case is that the informant and his friend Narendra Singh was coming on a motorcycle when cash of thirty thousand and mobile of the informant and cash of rupees one thousand four hundred forty from the pocket of the informant's friend were robbed leading to registration of FIR against six unknown. Name of the petitioner sprang up during investigation. It is submitted by the learned counsel for the petitioner that though the petitioner was declared absconder by the learned

Patna High Court Cr.Misc. No.19856 of 2016 (3) dt.11-05-2016 2/2 court below but no process was ever executed or served on the petitioner. The petitioner had no knowledge about the same and co accused Ram Babu Yadav has been acquitted vide S.T. No. 195 of 2009.

Considering the fact that the case was registered in 2008, this court is not inclined to interfere. However, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Sasaram (Agrer) P.S. Case No. 252 of 2008 pending in the court of learned C.J.M. Rohtas at Sasaram. This application is disposed of with the aforesaid observation/direction.
