JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-06-2019 Learned counsel for the petitioner submits that after receipt of Memo No. 1041 dated 17.09.2016, as contained in Annexure '6' to the writ application, the petitioner has submitted a representation dated 07.03.2017 vide Annexure '7' series in the office of the Director General of Police-cumCommandant, Home Guard, Bihar Home Guard Headquarter, Patna.
It is submitted that in Annexure '6' the petitioner was given an opportunity to place his stand before the concerned authority, now he has submitted his stand, the same should be considered and an appropriate order may be passed thereon. Learned counsel for the State has though opposed the
Patna High Court CWJC No.16582 of 2017(3) dt.10-06-2019 2/2 writ application, however it is not denied that the petitioner has submitted his stand vide Annexure '7' series in the light of the opportunity granted to him vide Annexure '6' to the writ application.
In that view of the matter, this court directs the respondent no. 3 to look into the representation of the petitioner as contained in Annexure '7' series to the writ application and pass an appropriate order thereon on the basis of the materials available on the record. Such an order be passed by respondent no. 3 within a period of three months from the date of receipt/production of a copy of this order.
