The petitioner seeks bail in Sessions Trial No.36 of 2019 arising out of Shakund (Sajour) P.S. case No.54 of 2018 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Additional District & Sessions Judge IXth, Bhagalpur.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application by a coordinate Bench of this Court taking into account that the petitioner is said to be the assailant.

A report was called for from the trial court. It has been reported that only Investigating Officer is to be examined in the present case.

Patna High Court CR. MISC. No.33600 of 2020(3) dt.15-01-2021 2/2 Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably at the earliest. Considering that only the Investigating Officer is to be examined in the present case, the District Magistrate, Bhagalpur and the Senior Superintendent of Police, Bhagalpur are directed to ensure that the Investigating Officer is produced on the date fixed by the Trial Court so that the trial could be concluded at the earliest.

Let this order be communicated to the District Magistrate, Bhagalpur and the Senior Superintendent of Police, Bhagalpur.
