JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is in custody since27.2.2015 for the offences under Section392 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 25.2.2015 when the informant along with his four associates, Ashok Mahaldar, Rajkishor Mahaldar, Ravindra Sah and Chhate Lal Sah proceeded towards Khuskibagh to purchase fish by their bicycle and reached Khatahat Bridge, 3-4 unknown miscreants surrounded them and took away Rs.8040/-cash and one lava Mobile phone from the informant, Rs.6400/- and one Samsung Mobile phone from Rajkishore Mahaldar, Rs.8070/- from Ashok Mahaldar, Rs.9050/- from Ravindra Sah and Rs.8000/- and one Nokia

Patna High Court Cr.Misc. No.25953 of 2015 (2) dt.23-07-2015 2/2 Mobile from the possession of Chhatalal Sah on the point of pistol and they fled away towards the village- Sadhuweli. It is submitted on behalf of the petitioner that the petitioner is in custody since 27.2.2015 and the charge sheet has already been submitted in the present case. It is further submitted that the petitioner is not named in the F.I.R. nor he has been put on test identification parade for ascertaining his involvement in the present case.

On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Ran Vijay Kumar, J.M., 1st Class, Purnea in Kasba P.S. Case No.41/15.
