JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 05-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Chandradeep P.S. Case No.06 of 2015 registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 326, 307, 506/34 and later on added Section 302 of the Indian Penal Code. The accusation is that in course of digging the earth by the petitioner in the filed of the informant, the informant made protest on which the petitioner started to abuse. In the mean time, Bablu Tanti, Bajo Tanti, Mithun Tanti and Bajrangi Tanti, the sons of the petitioner and Nirmal Devi, the wife of the petitioner armed with axe, lathi and danda came there and started to cause assault to

Patna High Court Cr.Misc. No.19380 of 2016 (2) dt.05-05-2016 2/2 the husband of the informant, who fell down sustaining injuries. At that time, this petitioner caused injury to the informant taking the axe from the hand of Bablu Tanti.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner is not the assailant of the deceased rather there is allegation against the petitioner that he abused and caused assault through axe at the chest of the informant.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate, First Class, Jamui, in connection with Chandradeep P.S.
