The Superintendent of Police, Rohtas at Sasaram is present in Court and has tendered unqualified apology for sending the letter to the learned Sessions Judge (Annexure B) knowing fully well that Sessions Trial No. 600 of 2014 was pending in the court of the learned 4th Additional Sessions Judge. In pursuance of the order dated 19.10.2016, the Superintendent of Police was directed to produce all the witnesses and file a petition before the trial court to hold the trial on day-to-day basis. The trial has been fixed on day-to-day basis and only two witnesses remained to be examined. The remaining two witnesses shall be examined within two days.

Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge

Patna High Court Cr.Misc. No.19646 of 2016 (5) dt.16-11-2016 2/2 the petitioner on bail in S.T. No. 600/2014, arising out of Suryapura P.S. Case No. 55/2014. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day-today basis and, after hearing the arguments, conclude the same within six months.

The personal appearance of the Superintendent of Police, Rohtas at Sasaram is dispensed with.
