The petitioner, who is in custody since 05.03.2020, seeks bail in connection with Kadamkuan P.S. Case No. 100 of 2020, dated 27.02.2020, instituted for the offences under Section 394 of the Indian Penal Code.

The petitioner has not been named in the F.I.R.,

Patna High Court CR. MISC. No.34471 of 2020(4) dt.25-03-2021 2/2 but his implication in the present case is only on the basis of confession of an arrested accused person. Later, the petitioner also is said to have made an inculpatory confessional statement and pursuant to that statement, incriminating articles have been recovered by the police. In any view of the matter, regard being had to the fact that the petitioner is in custody since 05.03.2020 and that in the other case in which he had been made accused in the past, he is on bail, this Court is inclined to grant him bail.

The petitioner/Vijay Kumar @ Shubham Kumar Gupta @ Shubham Kumar is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Patna in connection with Kadamkuan P.S. Case No. 100 of 2020.
