The petitioner seeks bail in connection with Revilganj P.S. Case No.27 of 2015/G.R. No.959 of 2015 registered under Sections 304(B)/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by her husband (petitioner) and Gotni due to protest made by her daughter with respect to illicit relation of her husband with her Gotni.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the deceased, the daughter of the informant. In fact, the deceased in heat of anger
Patna High Court Cr.Misc. No.18393 of 2016 (5) dt.27-07-2016 2/2 consumed poison and died. After the death of the deceased, the information was given to the informant, who had also come but with an ulterior motive, the present case has been lodged by the informant. Further submission is that Ranjeet Kumar, the brother of the deceased, and his three co-villagers have stated in their statement, as detailed in paragraphs-10 to 13 of the case diary, that the deceased under misconception that her husband has illicit relation with her Gotni consumed poison and died. The petitioner is in jail custody since 23.03.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Rai, Judicial Magistrate, Saran at Chapra, in connection with Revilganj P.S. Case No.27 of 2015/G.R. No.959 of 2015. (Rajendra Kumar Mishra, J) P.S./- U T
