JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-04-2019 The present writ petition has been filed for quashing the letter dated 26.05.2018 whereby and whereunder the District Programme Officer (Sakcharta), Gaya has directed all the Block Education Officers to forthwith stop taking work from the petitioners and others similarly situated candidates. The petitioners further seek quashing the order dated 19.5.2018 passed by the Director, Jan Shiksha.
The learned counsel for the respondents, referring to the counter affidavit, has submitted that the petitioners were illegally appointed, however, the respondents have been unable to show any order terminating the services of the petitioners, hence the Court is of the opinion that the respondents cannot create any impediment in the smooth functioning of the
Patna High Court CWJC No.555 of 2019(3) dt.26-04-2019 3/3 petitioners herein on the posts on which they are working. Having regard to the facts and circumstances of the case, the present writ petition stands disposed of in terms of the aforesaid opinion of this Court, however, with liberty to the respondents to take appropriate action in accordance with law.
