The petitioner is in custody in connection with Wazirganj P.S. Case No.385 of 2018, registered for the offence punishable under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he was involved in theft of motorcycle. Petitioner was not named in the F.I.R., rather case was registered against three unknown persons. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 03.01.2019.

Considering the facts that petitioner was not named in the F.I.R.. The F.I.R. was registered against unknown, whereas petitioner and informant are Pattidar. Let the petitioner,
