JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
The name of petitioner came in this case in confessional statement of co-accused and except the so-called confessional statement of co-accused as well as some criminal antecedent of the petitioner, there appears to be nothing against the petitioner. So far as recovery of shopping A.T.M. card is concerned, the same does not appear to be stolen property because the co-accused, Krishnachandra Prabhat disclosed in his
Patna High Court Cr.Misc. No.21354 of 2016 (4) dt.18-08-2016 2/2 confessional statement that all the stolen property had been kept by him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Supaul in connection with Supaul P.S. Case No. 539 of 2015.
