2. The petitioner is in custody since 10.12.2015 in connection with Singheshwar P.S. Case No. 185 of 2015 for the alleged offences under Sections 25 (1-B) A, 26(II), 35 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated only because he happens to be the friend of co-accused Sanjeet Kumar from whose possession a loaded pistol with two live cartridges were recovered and who has been granted bail in Cr. Misc. No. 14908 of 2016. The petitioner's case stands on a better footing from whose possession two live cartridges were recovered without any firearm.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be
Patna High Court Cr.Misc. No.21872 of 2016 (2) dt.19-05-2016 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District and Sessions Judge III, Madhepura in connection with Singheshwar P.S. Case No. 185 of 2015 subject to the condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
