After arguing the matter for some time on merits, being faced with the issue of availability of alternative remedy under Rule 24 (2) of Bihar Government Servants (Classification, Control & Appeal) Rules (for brevity Bihar CCA Rules), Mr Raju Giri, learned counsel for the petitioner

Patna High Court CWJC No.11547 of 2019(8) dt.13-12-2022 2/2 submits that he would be approaching the authority within two weeks. He, however, raises an apprehension that his application is likely to be met with the issue of delay.

The facts being so, this Court would record that pendency of the instant application before this Court would be a fact available to the petitioner for meeting the issue of delay before the Authority (Respondent No 2), under Rule 24 (2) of Bihar CCA Rules.

If the petitioner makes his application under Rule 24

(2) of Bihar CCA Rules within two weeks, the same is required to be disposed of by a reasoned and speaking order, in accordance with law within three months thereafter. Writ petition stands disposed of.
