Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kundwachainpur P.S. Case No. 53 of 2020 for the offence under Sections 457 and 380 of the Indian Penal Code. It is alleged that the petitioner was involved in theft of motorcycle.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 21.05.2020. He further submits that the petitioner was not named in the F.I.R. and only on the basis of suspicion he has been arrested in the instant case.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to

Patna High Court CR. MISC. No.36314 of 2020(2) dt.29-01-2021 2/2 be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Kundwachainpur P.S. Case No. 53 of 2020.
